The Gujarat High Court has,in a recent judgment,refused to direct the Hemchandracharya North Gujarat University to let a private pharmacy college in Sabarkantha district keep the intake of students to 60 for the academic year 2009-10. The pharmacy college run by the Gitanjali Trust in Sabarkantha had approached the HC after the university authorities had sanctioned only 30 seats against the colleges plan to enrol 60 students. In their petition,the college authorities had stated that the All India Council for Technical Education (AICTE) had fixed the intake of the petitioner college at 60. However,it added that the university authorities unjustifiably reduced the intake to 30. The petitioner also contended that the university authorities were acting with an ulterior motive to harass the petitioner college. It stated that the college has fulfilled all the requirements laid down by AICTE,and that the deficiencies pointed out by the university authorities for reducing the students intake by 50 per cent is nothing but an eye-wash. The petitioner even contended that they have even made necessary arrangements for 60 students. The universitys counsel had contended that the recognition granted by AICTE to the college was conditional and the petitioner college had not rectified the deficiencies pointed out by the AICTE. The petitioner has stated that the Trust has rectified all the deficiencies pointed out by the AICTE. If that be so,it can always take up the matter with AICTE. In any view,without AICTE in the array of parties,we will not be able to express our opinion on that averment, the division bench of Chief Justice K S Radhakrishnan and Justice Akil Kureshi said in the judgment. In this factual situation,the relief sought for by the petitioner cannot be granted, it added.
