Gujarat HC warns of contempt proceedings against ‘unruly elements’ obstructing traffic rule enforcement

On Wednesday, a Division Bench of Justice AS Supehia and Justice RT Vachhani made the oral order while hearing a 2019 petition seeking contempt for non-compliance of the HC orders in a 2017 PIL on traffic issues.

The Gujarat High Court expressed displeasure over the “mala fide” campaign against officers “endeavouring” to implement the directions of the court in the matter of strict enforcement of traffic rules, stating that the court will “take suo motu contempt proceedings against such elements”.

On Wednesday, a Division Bench of Justice AS Supehia and Justice RT Vachhani made the oral order while hearing a 2019 petition seeking contempt for non-compliance of the HC orders in a 2017 PIL on traffic issues. The government pleader GH Virk informed the court that officials endeavouring to implement the directions of the High Court were being “obstructed from discharging their duties”. While the government pleader did not name any entities, the court took strict note of the submissions made by Virk as well as Advocate Amit Panchal, who is appearing for the petitioner in the matter.

In an oral order, the court said, “…a grave concern has been raised by the learned Government Pleader (Virk), as well as the learned advocate (Panchal), that the authorities, who are endeavouring to implement the directions of this Court in accordance with law, are being obstructed from discharging their duties effectively. It has further been alleged that a mala fide campaign has been initiated against them by certain unruly elements, including sections of the electronic media.”

The court noted that Panchal would submit an affidavit highlighting the issue and appreciated the “sincere work and duties undertaken by the respective state authorities”. Stating that the court would take seriously any attempts to obstruct the officials, the order said, “We further clarify that any attempt made by unruly elements to prevent the implementation of the directions of this Court will be viewed seriously, and in case such obstruction occurs, this Court will take suo motu contempt proceedings against such elements.” The matter is now listed for August 20.
