Gujarat HC grants bail to 5 Congress workers, furnishes bail bond of Rs 10,000

None of the five played a vital role in commission of offence or were arrested in other FIRs, said advocate Hriday Buch

The Gujarat High Court on Friday granted bail to five Congress workers who were accused of stone pelting and rioting recently, following clashes between the BJP and the Congress workers over purported “anti-Hindu remarks” by Congress MP Rahul Gandhi in his maiden speech at the Parliament.

The five accused– Harsh Ishwarbhai Parmar (23), Vimalbhai Pansara (50), Manish Thakor (47), Sanjay Barot (57) and Mukeshbhai Datania (68)– were arrested based on a complaint filed by Paldi police station constable Karmaraj Bhagvatsinh who had suffered injuries in the clash.

An FIR had been filed under BNS for alleged rioting, stone pelting, and other offences against Congress leaders Shehzad Khan Pathan, Congress’ LoP (Leader of Opposition) in Ahmedabad Municipal Corporation, and Pragatiben Nandaniya, as well as against “around 200-250 Congress workers” and “a mob of 150-200 BJP persons”.

Following the incident on July 2, FIRs were lodged against Congress workers based on two complaints, one by the police constable and another by Ahmedabad city’s BJP Yuva Morcha wing chief. A third FIR was lodged against Bharatiya Janata Yuva Morcha (BJYM) members, based on the complaint filed by Himmatsinh Patel, former Bapunagar MLA and Ahmedabad city Congress Committee chief.

Advocate Hriday Buch, representing the accused, submitted before the court that none of the five are said to have played a vital role in the commission of the offence and pointed out that none have been arrested in the other FIRs.

Taking into consideration the allegations and the seriousness of the offences, the court of Justice MR Mengdey directed for the release of the five accused and furnished a bail bond of Rs 10,000 per head.

Earlier on July 11, the Ahmedabad court refused bail to the five accused after going through the photographs and CCTV footage of the incident. The court stated that it was a “clear case of assault on a public servant” and a “clear case of attack on police machinery”.
