Fast-track judges challenge their termination in HC

Two fast track court judges,who had been terminated by the state government in December 2009,have challenged their termination before the Gujarat High Court calling it ‘arbitrary and discriminatory’ step.

Two fast track court judges,who had been terminated by the state government in December 2009,have challenged their termination before the Gujarat High Court calling it ‘arbitrary and discriminatory’ step.

The Division Bench (DB) of Chief Justice S J Mukhopadhaya and Justice A S Dave is expected to hear the petition on Wednesday after three division benches of the HC ordered not to put the matter before it.

The two fast track judges who were terminated have been identified as Krupesh Vora and Bharat Trivedi. Vora and Trivedi were posted at the fast track courts at Nadiad and Mehsana,respectively.

According to the details of the case,the state government had terminated the two petitioners along with some others on the ground of unsuitability in an order dated December 15,2009.

However,the two had challenged the order in the Supreme Court of India even before the concerned office served the notice to them. On January 4,the apex court ordered the petitioners to approach the High Court with the petition. It had also ordered to maintain status quo in the matter for two weeks. Following the SC order,the two petitioners continued serving as fast track judge in their respective districts.

As per the SC order,the petitioners appeared before the HC with the petition. The petition first appeared before the division bench of Justices A L Dave and H N Devani. The division bench ordered not to put the petition before it. Similarly,two other division benches of Justices R R Tripathi and J C Upadhyay and Justices K A Puj and R H Shukla also ordered not to put the petition before it.

Subsequently,the petition has come up for hearing before the Chief Justice. On Tuesday,since the Chief Justice was on leave,the court,headed by Justice R M Doshit,granted one-day extension till Wednesday.

The division bench headed by the Chief Justice is expected to hear the matter on Wednesday.
