The Gujarat High Court,on Thursday,adjourned the next hearing of a petition of primary teacher from Sabarkantha district to after seven years. The petitioner in the case,a primary school teacher,has challenged the transfer procedure adopted by the District Primary Education Officer of Sabarkantha.
The petitioner,Naginkumar Patel,who is posted as a primary teacher in a school in Sabarkantha district,has sought transfer to his native district. Naginkumars lawyer S K Patel said,The District Primary Education Officer of Sabarkantha has adopted a very arbitrary method for the transfer. And so,we have challenged his action and sought to cancel the order.
The petition came up for hearing,on Thursday,before the court of Justice K S Jhaveri. After allowing certain amendments in the petition,the court adjourned the matter till the second week of January 2017. Draft amendment granted. Amendment to be carried out forthwith. Rule returnable in the second week of January 2017. Direct service is permitted today, said the order passed by the court on Thursday.
When contacted over the issue,the petitioners lawyer said,I have advised my client to file an appeal against the order. However,the ultimate decision is to be taken by him.
