Expressing satisfaction with the status report of CBIs investigation into the Sadiq Jamal Mehtar encounter case, the Gujarat High Court on Thursday granted the probe agency three more months to complete its probe by December 31.
During the hearing,Justice M R Shah said the status report which the probe agency filed before the court in a sealed cover showed there was progress in the investigation and that the agency had not wasted time and so it was entitled to get three more months as it had requested.
Earlier, senior advocate Mukul Sinha, who appeared for complainant Shabbir, brother of Sadiq, objected the CBIs demand saying it would help the arrested accused to get default bail. In case the CBI fails to file the chargesheet within a stipulated time,an accused is entitled to a default bail.
On this,Justice Shah said,I am not concerned with the accused getting the benefit of default bail. I am only concerned with the investigation into the case.
Sadiq was shot dead in Naroda area of Ahmedabad on January 13,2003,by a team of Ahmedabads crime branch. The police had claimed he wanted to kill Chief Minister Narendra Modi and other senior BJP and VHP leaders.
The case was handed over to CBI by the High court last year.
The CBI has so far made two arrests in the case,of Mumbai-based former journalist Ketan Tirodkar and Gujarat Polices Deputy Superintendent of Police Tarun Barot.
