Murder case against 11 cops 4 years after tribal girl’s death in Chhattisgarh

A case of murder has been registered against 11 policemen by the Chhattisgarh CID after a judicial probe found them guilty of killing a minor tribal girl in a fake encounter four years ago. This is the first instance when so many policemen were booked under Section 302 of IPC in a fake Maoist encounter case.

The girl was killed in an encounter near Chando village of Balrampur district on July 5, 2011. Her postmortem had confirmed injuries at her private parts, presence of semen on her clothes and possibility of multiple intercourse. While police had claimed that she was a Maoist, neighbouring villages had said the 16-year-old was gangraped and murdered by police. Following public uproar, a judicial commission headed by Justice Anita Jha was set up to probe the incident.

Refuting the state police and the home department, the judicial commission recently came out with its report and said that she was not a Maoist and was killed in a fake encounter. The report, however, was silent on the alleged gangrape. The policemen against whom the case has been lodged now were present at the Chando station that night. They were suspended some months after the incident, only to be reinstated later.

Jha made recommendations, based on which an Action Taken Report will now be submitted before the state assembly. While police had claimed that an encounter took place with a Maoist group for hours, only three bullets were actually fired, of which two hit her.

The Indian Express had reported that her postmortem report had a seemingly last-minute insertion of a few words that, surprisingly, commented about her alleged “habitual sexual behaviour”. While her relatives had claimed gangrape and murder, then state Home Minister Nanki Ram Kanwar had cited the postmortem report and said she had “relations with truck drivers”. “They first raped my daughter, then killed her and now call her charkati (slut). It hurts the most,” her father had then told The Indian Express.
