Gujarat HC declines to give copy of Ishrat chargesheet to IPS officer Satish Verma

The HC has ordered not to give a copy of the charge sheet to my client Satish Verma, his lawyer Rahul Sharma said.

The Gujarat High Court Friday allowed the CBI appeal against providing the copy of first chargesheet in Ishrat Jahan encounter case to IPS officer Satish Verma, the lead investigator of the case. The court upheld the CBI’s argument that Verma couldn’t be given the copy as he had no locus standi in the case.

The single bench of Justice B N Karia pronounced the order, allowing the CBI appeal against the order of a special CBI trial court which had granted permission to Verma to get a certified copy of the first chargesheet in the case.

Following the special court’s order, the CBI had sought a stay on the order and moved the HC.

In March, Verma had moved the court, seeking a copy of the chargesheet, stating that he believed that “a serious and concerted attempt is being made to cause miscarriage of justice, by attempting to negate or weaken the evidences collected in the investigation….”

The first chargesheet, filed in 2013, names seven Gujarat police officers, including in-charge DGP P P Pandey and IPS officers D G Vanzara (retired), G L Singhal, N K Amin, among others.

He had also sought a copy of the second chargesheet, naming four Intelligence Bureau (IB) officers, including former special director Rajinder Kumar, which was also rejected.

Currently, Verma is on Central deputation in Shillong as Chief Vigilance Officer (CVO), NEEPCO.

He was part of the three member Special Investigation Team (SIT) appointed by the Gujarat High Court to probe the Ishrat Jahan encounter case.

The SIT had found that 19-year-old Ishrat Jahan, her friend Pranesh Pillai alias Javed Shaikh and two alleged Pakistanis — Zeeshan Johar and Amjadali Rana — were killed in an alleged fake encounter. Later, when the High Court handed over the probe to CBI, Verma was also asked to assist the central investigation agency.

Last month, Verma was reportedly issued show-cause notice by the NEEPCO for alleged misconduct and unauthorised absence from duty.

He has been asked to explain the absence from duty and travelling without permission.
