Allow South corporation to build garbage dump in Dwarka, court tells DDA

The Delhi High Court, on Wednesday, directed the Delhi Development Authority (DDA) to allow the South municipal corporation to construct a closed dhalao (garbage dump) in Dwarka to stop dumping of waste on roads and open areas.

Observing that the civic agencies “appear to have no respect for the Prime Minister’s Swachh Bharat Abhiyan,” the court of Justice Badar Durrez Ahmed noted that garbage was accumulating in open areas in Dwarka despite orders from the court and the Modi government’s campaign.

During the proceedings, the counsel for the South civic body argued that the areas where garbage is accumulating — as shown in the pictures submitted by petitioners — are open dhalaos from where garbage is regularly removed. However, the counsel submitted that a closed dhalao needs to be constructed in the area.

The court, however, was of the view that “only garbage was visible”. “Where are the people whose job it is to clear the rubbish? Why don’t you take action against them (safai karamcharis) if they are not doing their job?” the court asked the civic body.

The court has now directed the South municipal corporation to regularly clean the areas where garbage is accumulating and to also take pictures before and after undertaking the exercise.

The Bench also made it clear that if the area is not cleaned regularly, the sanitary superintendent of Najafgarh zone “will be held personally responsible”.

Meanwhile, the court has also sought a joint statement from the Delhi Metro and DDA to clarify who owns the land beneath the metro tracks in Dwarka.

The court sought the information after DMRC said that land below the tracks belongs to DDA while  the land-owning authority said it belongs to the Metro.

According to petitioners Ebbani Aggarwal and Gaurav Deep, the land under the elevated metro tracks in Dwarka is also being used to dump garbage and construction material.
