Sohrabuddin: HC dismisses bail petitions of Yashpal Chudasama,Ajay Patel

In a significant judgment,the Gujarat High Court has dismissed the anticipatory bail petitions of Yashpal Chudasama and Ajay Patel in connection with the Sohrabuddin Sheikh fake encounter case.

In a significant judgment,the Gujarat High Court has dismissed the anticipatory bail petitions of Yashpal Chudasama and Ajay Patel in connection with the Sohrabuddin Sheikh fake encounter case. Justice Anant Dave pronounced the judgment on Wednesday.

Both the accused are senior office-bearers at the Ahmedabad District Co-Operative Bank in the case.

Chudasama and Patel are accused of destruction of evidence and the court also considered the statements of two witnesses,Dashrath Patel and Raman Patel,in this regard.

The judgment assumes significance since another single judge bench presided by Justice Rajesh Shukla had granted the two accused anticipatory bail for 90 days on September 21.

The bail period ended on Tuesday and the two had again approached HC to grant them anticipatory bail or to extend the bail period granted by Justice Rajesh Shukla.

Justice Dave dismissed the petition on merit while considering the gravity of the offence involved and the fact that the punishment for the same may go up to life imprisonment.

The court also considered the arguments from the

Central Bureau of Investigation (CBI) that the investigation is still on and the two’s custodial interrogation is necessary to carry out further investigation.

At the request of the two accused’s lawyer,the court has granted stay on the judgment for three weeks so that the accused can challenge the order at a higher forum.
