Early hearing on Rathore’s petition in HC

To ensure there is no delay in hearing and deciding a petition filed by S P S Rathore,demanding quashing of abetment to suicide charges against him,the Punjab and Haryana High Court has fixed the case for early hearing.

To ensure there is no delay in hearing and deciding a petition filed by S P S Rathore,demanding quashing of abetment to suicide charges against him,the Punjab and Haryana High Court has fixed the case for early hearing.

The cause list released for regular cases (admitted) for June 28 before the division bench of Chief Justice Mukul Mudgal and Justice Ajay Tewari show that the case has been listed for early hearing. In a normal course,an admitted petition takes a minimum of five years for hearing but Rathore’s petition will be taken up for hearing before a division bench headed by Chief Justice.

On January 25 Justice Sabina of the High Court had admitted a petition filed by Rathore,who is convicted for molesting Ruchika Girhotra,demanding quashing of the abetment to suicide charges under Section 306 of the Indian Penal Code (IPC).

Justice Sabina had referred the petition to a division bench for adjudication holding that an important question of law needs to be decided. The development assumes significance as the CBI has been directed not to file a chargesheet for abetement to suicide till the petition is decided.

On January 25,the High Court had stayed his arrest in the two FIRs registered against him on charges of attempt to murder and forgery. Rathore had filed two anticipatory bail applications in this regard. The revision petition filed by Rathore challenging his enhanced sentence of eighteen months is also listed for early hearing. The revision petition will come up for hearing on June 29. Terming the offence committed by Rathore as odious Justice Ajay Tewari had listed the revision petition early hearing as well. Till the revision petition is decided,Rathore will remain behind bars.
