Cop shifted after hooch tragedy moves HC,DGP gets notice

The court issued the notice after a lawyer for the state government told the court he had no instructions on the matter.

The Gujarat High Court on Thursday issued a notice to the Director General of Police (DGP) on an application moved by a constable who was transferred out of his parent cadre of Ahmedabad city to Jamnagar district following the 2009 hooch tragedy for his alleged links with a bootlegger.

The court issued the notice after a lawyer for the state government told the court he had no instructions on the matter.

The petitioner constable,Hadmatsinh Sisodiya,had challenged his transfer at the High Court saying the authorities had made constabulary a scapegoat following the hooch tragedy while no action was taken against senior police officers who were in charge of the areas where the deaths took place.

A division bench had directed Sisodiya to make a representation on his transfer to the DGP and asked the state police chief to decide on the representation within three weeks. However,according to Sisodiya,the DGP did not decide on his representation under the pretext of a pending departmental inquiry even after it was over.

In his application moved before the HC,Sisodiya said his representation had been pending for more than two years now.

Sisodiya’s lawyer Panthil Majmudar said,“On Thursday,a lawyer representing the state government told the court that the government pleader was to appear in the matter. So the matter was kept in the second half of the day. However,when the government pleader did not come finally,the other lawyer said he had no instructions on the matter. Following this,the court issued notice to the respondents,the state government and the DGP.”

The hooch tragedy of July 2009 had left over 100 people dead. Following the tragedy,a number of policemen from the constabulary were transferred.
