In a blow to the CBI,former founder-chairman of Satyam Computer B Ramalinga Raju was today granted bail by the AP High Court. The high court granted bail to Raju on health grounds despite objections raised by Additional Solicitor General Harin P Raval on behalf of the CBI that if Raju is let out on bail he may influence witnesses and tamper with evidence. The High Court said Raju should not be discharged from the hospital. With this,all the accused in the Rs 7000-crore fraud are out on bail.

Meanwhile,corporate affairs minister Salman Khurshid said in New Delhi today that the bail granted to B Ramalinga Raju would not hamper investigations. “It (the bail) will not,it never does. The trial courts keep this in mind. I think this is the law of the land and this does not worry us,” Khurshid told reporters. On whether the bail would tarnish India’s image internationally for handling the Satyam case,Khurshid said,“We will handle… Bail is a rule,jail is an exception.”

Raju’s senior counsel Bharat Kumar said,“He has been given bail on the condition that he will remain in the city till further orders and will have to give two securities of Rs 20 lakh each. After the treatment if he is discharged from hospital,he will have to depose before the investigating officer daily.”’

On August 16,the High Court had reserved its order on the bail petition filed by Raju. Additional Solicitor General Harin P Raval,who argued against the grant of bail on behalf of the CBI,filed an application before the court requesting it to form a special team of doctors to look into the health of Raju.

Raju has been hospitalised at Nizam’s Institute of Medical Sciences in Hyderabad for treatment of Hepatitis C since September 2009. A panel of NIMS doctors submitted a report to the court that he still requires treatment for 16-18 weeks. Though court proceedings have started,Raju has not once appeared in court so far. On July 1,Raju’s doctors submitted a report to the court stating that due to his medical conditions,Raju was suffering from excessive weakness and palpitations, occasional bleeding from the nose and stools,loss of appetite, breathlessness,swelling and infection of nail bed,itching behind the ears and burning of eyes. The medical report stated that he needed another 26 injections,one each week.

Raju has been charged under various sections of the Indian Penal Code including Section 120B for criminal conspiracy,under Section 409 for breach of trust,under Section 420 for cheating,and under Section 468 and Section 471 for forgery. Citing health grounds he has been avoiding appearing in court for examination.
