The Delhi High Court on Tuesday reserved its order on the anticipatory bail plea of former Haryana minister Gopal Goyal Kanda,wanted in connection with the suicide of former flight attendant Geetika Sharma. Justice P K Bhasin reserved the order after counsel appearing for Kanda and the Delhi Police concluded their arguments.
Appearing for the police,Additional Solicitor General (ASG) Siddharth Luthra said Kandas custodial interrogation was needed to find out the conspiracy between him and co-accused Aruna Chadha,who is now in police custody.
The ASG said Kanda has been on the run despite a notice having been served upon him to join the investigation and argued that a person who was absconding in this manner could not be granted anticipatory bail.
Further,he said during investigations it was found that Kanda had removed laptops and computers from his office in an attempt to destroy evidence against him.
Looking into his conduct of not joining the investigation,removal of all electronic items including his laptop and computer from his office…it is a case for refusal of anticipatory bail, Luthra said.
Appearing for Kanda,senior advocate K T S Tulsi said no case was made out against his client for abetment to suicide and that Geetikas suicide note could not be taken as the absolute truth.
The suicide note cannot be the gospel truth and the same has to be proved by independent evidence. Suicide letters are written in anger and so any allegations can be levelled out of anger, Tulsi said.
Luthra argued on the other hand,that the suicide notes themselves were very telling. This is the case of a young lady who wanted to move on with her life but was not being allowed to do so, he said.
