HC orders govt to pay Rs one lakh compensation to lawyer

The Patna High court today directed the state government to pay a compensation of Rs one lakh to a lawyer for breach of his personal liberty by some policemen from whom this amount should be recovered.

The Patna High court today directed the state government to pay a compensation of Rs one lakh to a lawyer for breach of his personal liberty by some policemen from whom this amount should be recovered.

Justice V N Sinha passed the order on a petition filed by a lawyer H Himkar alleging that his personal liberty as enshrined in article 21 of the constitution was breached by some cops of Rajiv Nagar police station in the state capital two months ago.

In the petition,Himkar alleged that Rajiv Nagar police station’s Officer In-Charge (OIC) G D Upadhyaya,constable R S Singh and others had visited his house on May 10 this year and misbehaved with him by using foul language that amounted to breach of article 21 of the constitution that provides for protection to life and personal liberty.

Finding the accused cops guilty of the charges,the judge directed the suspension of the cops and also ordered the state government to pay a compensation of Rs one lakh to the petitioner and recover the amount from the cops responsible for breaching personal liberty of Himkar.

The court issued directives to the Home Secretary and the Director General of Police (DGP) for compliance of its order.
