A day after the police registered a case of murder and attempt to destroy evidence against unknown culprits in the death of a seven-year-old girl in Maharashtra BJP chief Nitin Gadkaris car on May 19,a Bombay High Court Bench wondered why a case of murder was not registered in the case earlier. The observation was made by vacation Judge Justice C L Pangarkar at Nagpur bench of Bombay High Court when public prosecutor informed him that two offences under section IPC 302(murder) and 201 had been registered on Monday in the case. Initially,a case of accidental death was registered by the Kotwali police. The police had then also ruled out rape and murder and had even cited the post-mortem report to buttress their claim. The judge fixed June 10 as the date for next hearing and asked the Maharashtra Government to file a detailed reply. Yogitas parents Vimal and Ashok Thakre,in a criminal writ petition,said the death was due to smothering as per the post-mortem report and amounted to homicide. Even the car was removed immediately by staff members of Gadkari without police conducting a panchnama of the vehicle,their counsel Anjan Dey told the court.
