The Centre on Monday told the Delhi High Court that a Warrant of Precedence and orders for holding a state funeral for Field Marshal Sam Manekshaw came directly from Prime Minister Manmohan Singh.

A Bench led by Chief Justice Ajit Prakash Shah termed the delay in announcement of the state funeral as “tragic”. The matter came up for hearing following a letter by Supreme Court advocate P L Juneja, who said the cause for the delay was “unheard of and caused unprecedented shame and humiliation” to the country.

“At funerals there is no Warrant of Precedence,” Additional Solicitor General (ASG) P P Malhotra, appearing for the Centre, told the Bench.

Malhotra submitted that the state funeral was held for the iconic former Army chief specifically on the request from the Defence Ministry to the Prime Minister. “The Prime Minister had agreed for the state funeral at the request of the Defence Ministry,” he told the court.

“Flying the National Flag at half-mast requires a specific order from the Prime Minister,” the ASG reasoned, with the court dismissing the PIL.
