NEW DELHI, JULY 26: The Cellular Operators Association of India (COAI) met here today and decided to “unconditionally” accept the new telecom package. Most of the operators are likely to withdraw the litigations against the Government, as a pre-requisite for making companies eligible to move to the new package.

However, metro operators, sources say, have reservations about specific mention of which cases have to be withdrawn from the courts. The operators are uncomfortable about withdrawing the case relating to the jurisdiction of the Telecom Regulatory Authority of India (TRAI) pending with the Delhi High Court.

Meanwhile, the TRAI is expected to approach the Delhi High Court to pronounce the judgment on the case which has already been heard. “We will ask the court to convert us from the respondents to the appellants in the given case if the private operators withdraw their case,” explained Justice S S Sodhi, chairman of the TRAI.

B K Zutshi, vice-chairman of the TRAI, said that a clarity on the jurisdiction of the TRAI was necessary for both the regulator as well as the industry. “This issue will have to be addressed sooner or later as it is likely to crop up every now and then,” Zutshi explained. Further, he explained, even if all cases relating to the period before July 31 are withdrawn, the jurisdiction issue may resurface again.
