Tata Teleservices today filed a petition in telecom dispute settlement tribunal (TDSAT) demanding that the Department of Telecom (DoT) should ask GSM operators to surrender excess spectrum beyond the contracted 6.2 MHz. The company also sought a level-playing field with the GSM players on spectrum allocation, which is 2:1 in favour of GSM operators.
“All future allocation of spectrum, beyond the contracted amount, be made in a transparent and non-discriminatory manner on the basis of a comprehensive spectrum policy,” Tata Teleservices (TTSL) said.
Tatas have been opposing the allocation of frequency to CDMA players in the ratio of 2:1 (in favour of GSM), especially at a time when firms in both the segments have paid the same entry fee. “Both GSM and CDMA operators, after migration to Unified Access Service (UAS) licence like Tata Teleservices have paid same entry fee and therefore, it could not be placed on any term inferior to GSM service providers,” said the petition.
Earlier, TTSL had rejected settlement package proposed by DoT stating, “it is very dismaying that the proposal again talks about spectrum allocation, which is 2:1 in favour of GSM. It is this very cause which has pushed CDMA players to move towards GSM as the frequency allocation to GSM has been very liberal.”
TTSL has also requested a stay on the proceedings of the committee constituted by DoT last month for allocation of spectrum. It has also sought amendment to the terms of reference of the above committee or formation of a panel as to include revision of spectrum allocation procedure and quantum of radio waves to CDMA operators. In the petition, Tatas alleged that DoT circular on these issues was completely “arbitrary, unreasonable, illegal and contrary to the terms of NTP 1999”.
