NEW DELHI, JULY 26: Former Union Law Minister Ram Jethmalani was checked by Rajya Sabha chairman Krishna Kant from making his statement since in its present form, it allegedly cast aspersions on persons holding “high judicial and public office” who cannot come to their defence in the House.

Another reason cited was that Jethmalani had enclosed certain documents which were marked “Secret.” As per norms and the oath of secrecy, no former minister can retain with him or her “secret papers” after demitting office and disclose their contents later.

In fact, the chairman’s office was taken by surprise this morning when it received the statement from Jethmalani. As per the informal agreement between the Prime Minister’s Office and Jethmalani, the latter had agreed not to attack the Prime Minister for his ouster. But he had made it clear that he would not spare anyone who “hatched a conspiracy” to oust him.

However, Jethmalani made critical references to Chief Justice A S Anand and also attacked Attorney General Soli Sorabjee on issues including judicial appointments.

Jethmalani is also said to have attached his correspondence with the Prime Minister and the Chief Justice of India over the appointment of the MRTPC chairman and the subsequent refusal of the CJI to administer the oath even after the Presidential notification.

Incidentally, this correspondence with the CJI was marked `Top Secret’ by Jethmalani himself when he was holding office.

Though officially Deputy Chairperson Najma Heptullah announced in the House that the statement had been deferred as the “Chairman wanted time to study the papers presented by the former minister and the attachments would have to be authenticated by Jethmalani,” it is learnt that chances are the statement will not be allowed to be read in its present form.
