The Supreme Court today rejected the Tamil Nadu government’s plea to stay the Madras High Court judgement which had struck down its order abolishing CET for professional courses.

“Let the students be admitted on the basis of the common entrance test. No case is made out for any interim relief,” a Bench comprising D.M. Dharmadhikari and Justice S.H. Kapadia said, refusing to even issue a notice on the state government’s appeal. The matter will be heard after the summer vacation. The Madras High Court’s June 27 order had given relief to thousands of students who had got admission to professional courses on the basis of the CET.

The students who had scored better in the Class XII improvement examination were also given relief by the first bench, comprising Chief Justice Markandey Katju and Justice F.M. Ibrahim Kallifulla. The Bench held that the improvement examination, which the state government had abolished, would be valid for the current year.

Allowing a batch of over 400 petitions filed by students challenging the government order, the judges said they were not inclined to interfere with the order on the improvement examination as it was a policy decision. However, with the exam already conducted and results declared, it would not be proper for the state government to cancel it this year, it said.

Meanwhile, PMK founder S. Ramadoss, on Monday demanded that the state bring an ordinance to abolish the CET.
