The Supreme Court on Monday refused to entertain a petition seeking disqualification of 18 Rajasthan MLAs for allegedly violating their oath of office by adopting a partisan stance on the ongoing Gurjjar strike. A vacation Bench of Justices Arijit Pasayat and G S Singhvi said Kashi Purohit, the petitioner, could seek alternative remedy with an appropriate court.

By adopting a partisan stance on the ongoing Gurjjar stir, the petitioner had alleged, the MLAs had violated their oath of office under which they were supposed to protect the interest of all people. According to the petitioner, the MLAs belonging to the Congress, BJP and BSP were indulging in “competitive politics by either supporting or opposing the Gurjjar stir and making inflammatory speeches”.
