Changes in the Prevention of Corruption Act are in the pipeline making it compulsory to secure sanction before prosecuting retired government servants to protect them from harassment.

The decision to amend the 1988 Act was taken at a meeting of the Union Cabinet chaired by Prime Minister Manmohan Singh in New Delhi on Friday.

The meeting approved introduction of Prevention of Corruption (Amendment) Bill, 2008, in Parliament, Science and Technology Minister Kapil Sibal told reporters.

He said the Bill will seek to give protection to retired government servants, as many of them were prosecuted without any sanction.

“A lot of government servants are harassed and many of them after retirement do not have means to defend themselves,” Sibal said when asked about the purpose behind the move.

He clarified that sanction for prosecution would be required for those retired officials who during their service period had the privilege.

At the same time, he said, if prosecution was sanctioned against a retired government servant, his property could be confiscated.
