Rizwanur case: Todis not to surrender

Ashok Todi and his two relatives, who have been issued non-bailable arrest warrants for allegedly abetting the suicide of Rizwanur Rahman, will not surrender at least till November 3, their lawyer said in Kolkata on Wednesday.

“We are not contemplating surrendering to the CBI at present and will move the SC seeking clarification of its order regarding stay of trial till disposal of an appeal by Ashok Todi (Rizwanur’s father-in -law),” their counsel Ayan Chakraborti said.

The CBI has secured suspension of passports of Ashok Todi and his brother. The CBI sources said the agency had applied for revocation of their travel documents immediately after they, along with three others, were chargesheeted by it. An alert has been sounded against Todis.

“On November 3, when the case will again come up for hearing, we will tell the court that the trio is absconding. Then with the court’s permission we can get a ‘look out notice’ issued against the trio,” a source in the investigating agency said.

On October 27, the CBI court in Kolkata had issued an arrest warrant against Todi, his brother Pradip Todi and brother in-law Anil Saraogi, observing that their non-appearance despite summons was an attempt to delay the proceedings. Chakraborty said they would pray for a clarification of its order of October 13 before the SC when it reopens on November 3. He said his clients would move an appeal against the warrants before either the city sessions court or the Calcutta High Court.
