June 29: A 62-year-old policeman was acquitted of the charge of raping an 18-year-old girl by the city civil and sessions court for lack of evidence and loopholes in the police investigations recently.
The sessions judge for cases of atrocities on women, dowry death and rape, V R Singbal, acquitted Sitaram S Ghadigaonkar, accused of raping the girl four years ago. The girl had alleged that constable Ghadigaonkar, attached to the traffic police at Worli, had raped her twice on May 13, 1993.
However, she was found missing since the incident and was arrested by the railway police at the Mumbai Central railway station on May 25, 1993. She was later handed over to the Dadar police station as she had alleged that the constable raped her at the Bharat Green lodge situated at Dadar. The police failed to establish the whereabouts of the girl during those days.She then lodged a complaint with the Dadar police. According to the First Information Report (FIR), Ghadigaonkar was known to the girl’s mother. On May 13, 1993, the constable had come to her residence and promised to find her a job. He then allegedly took her to the lodge and raped her at 3 pm and 12.30 am, the FIR mentioned.
The Dadar police had filed a case of rape against Ghadigaonkar and arrested him on June 2, 1993. At that time, he was over 57 years old. As he faced an allegation of as serious a nature as rape, he was suspended from the police service. However, he retired six months later as he turned 58.
Advocate Manohar Kandalkar defended Ghadigaonkar, while police prosecutor Jamdar represented the state.
