The Pratapsingh Rane government will now have some explanation to do to the Supreme Court. Today, it issued notices to Rane to show cause why the functioning of his government should be not stayed.
The notice was issued by a bench comprising Chief Justice R.C. Lahoti, Justice B.N. Sri Krishna and Justice D.M. Dharmadhikari on a petition filed by the former Chief Minister Manohar Parrikar. The petition will now come up for hearing on February 24.
Presenting Parrikar’s case, former Attorney General Soli Sorabjee said Governor S.C. Jamir’s decision to dismiss the BJP Government just hours after it won a majority in the house was illegal.
Sorabjee charged Jamir of acting in a partisan manner by removing the duly elected government without even waiting for the speaker’s report on what happened inside the house. He requested the court to direct convening of a special session of the Assembly on February 24 for a “composite floor test” to decide who enjoyed the majority, Rane or Parrikar.
Sorabjee also criticised the Governor for giving only 48 hours to Parrikar government to prove its majority while on the other allowing a broader time schedule for Rane.
