CHANDIGARH, Sept 28: UT District and Sessions Judge, B S Bedi, today reserved orders till tomorrow on the bail pleas furnished by executive engineer (electrical) Sadhu Singh and junior engineer K K Salgothra in the Engineering Department kickbacks case.
The duo were earlier arrested by the UT Vigilance Department on September 14 under the Prevention of Corruption Act, besides Sections 406, 409, 420 and 120-B of the Indian Penal Code in the FIR registered against former chief engineer K K Jerath.
According to the prosecution, two enteries of Rs 6,000 and Rs 3,300 were scribbled against the executive engineer’s name, while Rs 5,000 was scrawled twice against the junior engineer’s name in the diaries belonging to the alleged middlemen.
Today, seeking their release on bail, the defence counsel contended that the accused were being implicated in the case.
Their names were not mentioned in the FIR, nor was there any direct evidence against them. The enteries were made against their names in the diaries by the prosecution during the police remand of the alleged middlemen, the counsel stated.
Further, the FIR stated that the power to purchase had been withdrawn from the XENs and JEs. The orders were being placed by Jerath through the "middlemen", the counsel added. Salgothra, being a junior engineer was remotely concerned with the placing of supply orders. Moreover, nothing incriminating was recovered during raid at his residence by the authorities, the counsel said.
