Following the Supreme Court’s directive, the Gujarat government on Thursday set up a committee (an official note mentions a Special Cell) under the state DGP to reassess, evaluate and decide on reinvestigation and supervision of all summary cases — about 2,100 — relating to the post-Godhra communal riots.
DGP A.K. Bhargav was authorised today to constitute the panel comprising two additional DGPs, seven IGP-rank officials along with four range DIGs. The committee also includes a Muslim officer, S.S. Khandwawala (additional DGP, Training).
Bhargav told The Indian Express that the IGPs/DIGs would look into the FIRs, the existing materials in support of those FIRs or any other material found or brought to their notice, and then decide whether any of the 2,100 cases needs further investigation. In case they conclude that no further probe is required, the officers would have to provide reasons and send it to the DGP who, in turn, would post it on the internet to inform anyone who may be interested in bringing any new facts to the notice of the special cell.
The range IGPs/DIGs will report to the two additional DGPs who will ensure the veracity of the reports and submit the same to the DGP who will, in turn, report to the SC. The DGP will send such status reports to the apex court every three months.
In cases where further investigation is required, it will be carried out by an officer to be nominated by the special cell after forwarding its report to the authorised judicial magistrate concerned. The NGOs participating in this process will be at liberty to draw the attention of range IGPs/DIGs to any particular case on whether it needs further/fresh investigation.
