MUMBAI, April 1: Principal Sessions Judge A S Aguiar today rejected an application by music director Nadeem, prime accused in the Gulshan Kumar murder case, to direct the Mumbai police to furnish records of telephonic conversations which served as evidence against him.
Nadeem’s counsel Majeed Memon submitted before the court that his client could use this information to defend himself in London, where he is fighting an extradition case filed by the Indian government. The judge observed that that section 233 (3) of CrPc which empowered a magistrate to issue process for production of documents sought by an accused is applicable only after charges are framed. In the Kumar case, the charges are yet to be framed, he observed. The judge observed that the production of printouts to disprove the case of conspiracy by Nadeem to kill Kumar is unncessary for the purpose of deciding extradition.
