The Madras High Court today ordered the immediate release of all arrested state government employees for participating in the indefinite strike immediately on furnishing a personal bond of Rs 1,000 each. However, it refused to intervene in the issue of their dismissal by holding that the State Administrative Tribunal was the appropriate forum to adjudicate on it.
The first bench comprising Chief Justice B. Subhashan Reddy and Justice K. Govindarajan ruled that the writ petitions filed by the various government employees’ unions ‘‘are not maintainable without exhaustion of the remedy before SAT.’’
Even while directing SAT to dispose of the matter ‘‘as early as possible’’, in view of the ‘‘problem and the urgency involved’’, the court said it would be ‘‘open to the aggrieved parties to file applications before the appropriate authority indicated under the Ordinance for revocation of the punishments inflicted on them and if such applications are filed, they shall be disposed of by the state authority not later than a month from the date of receipt of such application, by affording reasonable opportunity.’’
Under the Ordinance, the appropriate authority is the official who can make such appointments.
