The Anti-Corruption Bureau on Tuesday arrested an executive magistrate and her husband for accepting Rs 50,000 as gratification to see that an order backed by one from Gujarat High Court was implemented.
Naliniben Upadhyay and her husband Harishbhai, who accepted the bribe on her behalf from Amrutbhai Patel of Mehsana, have been remanded to judicial custody and are lodged in Sabarmati jail.
Patel told the police that he and his uncle had bought a shop at Bhavya Complex in Bopal in 1997, after making full payment. However the builder had recently begun pressuring them for more money, saying land price in the area had shot up. Since the complex was run as a co-operative, Patel moved the Co-operatives Board of Nominees which dismissed Patel’s petition, but stayed transfer of the property.
Meantime, the builder filed a suit in the court of Upadhyay, who ordered immediate transfer of the shop to the builder.
Patel then moved the Gujarat High Court. On September 2, 2004, the court directed the Board of Nominees to hand over possession of the shop to Patel, who approached Upadhyay with the order. But the magistrate allegedly demanded Rs 50,000 as gratification.
