The Gujarat High Court today reserved its order till December 1 on which agency should investigate the 2004 “fake” police encounter of Mumbai college girl Ishrat Jahan and three others,and whether or not a fresh FIR should be filed in the matter.
A Division Bench of Justices Jayant Patel and Abhilasha Kumari concluded the hearing to finalise the agency that would investigate the encounter and if a fresh FIR was required to be filed,now that the encounter was found to be “fake” by the HC-appointed Special Investigation Team (SIT).
After the SIT concluded that the four were killed in a staged gunfight and their deaths had occurred prior to the time and place mentioned in the police FIR of June 15,2004,the HC had sought opinion of the petitioners,Gujarat and Central Governments on which agency should probe the case.
The hearing saw reversal of demands as the two petitioners,who had initially sought a CBI probe,today opposed investigation by the Central agency.
Also,the State Government,which had opposed a CBI probe earlier,today expressed readiness for inquiry by the premier agency,though it was its third preference after Gujarat Police and NIA (National Investigation Agency).
The State was opposed to the present three-member SIT,headed by an IPS officer,continuing with the probe in the episode.
