LUCKNOW, AUGUST 2: Former UP chief minister and Rashtriya Kranti Party president Kalyan Singh said today he would not appear before the Justice M S Liberhan Commission if it was not legally binding on him. Singh left for New Delhi tonight with his lawyer Brij Bahadur Saxena to consult senior lawyers.

A similar case with similar allegations is pending with the CBI court and he is appearing before it, Singh said. He said that though he had full respect for the Commission, he saw “no use” in appearing before it.

Singh’s refusal to appear before the Commission for months had required him to appear before the court for the first time on July 20. But he disobeyed it. He was again asked to appear on July 27. As usual, he did not turn up.

Ever since Singh floated a new party, he has been alleging that leaders of the BJP, VHP and the RSS had conspired to demolish the Babri Masjid. Citing this allegation, the Commission had justified its order on him.

In its June 21 order, the Commission had said that Singh was such “a key witness” that it could not answer any question without examining him. Singh and Principal Secretary (Home) Prabhat Kumar had denied that they refused to use any of the central para-military forces to prevent damage to the Babri Masjid.

Kumar even told the Commission that it was Kalyan Singh who had taken the decision not to deploy the central forces in Ayodhya.
