
Metropolitan Magistrate M.S. Brahmbhatt, from whose court bailable warrants were issued against President A.P.J. Abdul Kalam and Chief Justice V.N. Khare among others, was suspended on Thursday by the Gujarat High Court for ‘mis-conduct and conduct unbecoming of a judicial officer.’
The orders were also issued from Metropolitan Court No. 10 against judge of the Supreme Court Justice B.P. Singh and former president of Supreme Court Bar Association R.K. Jain on January 15, 2004, and are to be executed before February 17. The bailable warrants were issued as a result of a sting operation carried out by a private TV channel.
Chief Justice of the HC Bhawani Singh held an emergency meeting with the 28 high court judges and decided to suspend Brahmbhatt. Meanwhile, Brahmbhatt, who was appointed Metropolitan Magistrate in 2001, said he would not like to comment on the issue and will wait for the high court decision.
President of the Ahmedabad Criminal Court Bar Association Harish Bhawaniwala, who was one of the four advocates allegedly involved in the matter, refuted the allegations. He said the petitioner had approached him posing as a Delhi-based business. ‘‘Warrants were issued, but no proper designations and addresses were mentioned,’’ he said, accusing the petitioner of suppressing facts. Bhawaniwala admitted that he had argued the matter but had no clue about the petitioner’s intentions.
Two other advocates Narendra Chaudhary and Iqbal Katra, who are also allegedly involved, refused to comment on the media reports and said the Association was supporting them. ‘‘We will wait for the CBI reports and will protect our advocates if they are honest,’’ said Association vice-president J.R. Dave. He said the Association intended to form a committee to probe the matter on its own and would decide on action against the media.
