LUDHIANA, June 12: The District Consumers Disputes Redressal Forum has sentenced Estate Officer of Punjab Urban Development Authority (PUDA) to one month imprisonment and also imposed a fine of Rs 2,000 for non-implementation of an earlier order passed on May 30, 1997.

In its earlier order, the forum had ordered the PUDA to include the name Surinder Kumar Soni, a resident of Kidwai Nagar locality, in draw of lots. PUDA was also asked to pay him Rs 3,000 within a month.

An appeal filed by PUDA against the order was decided and dismissed on October 20, 1997 by the forum and the orders were served to PUDA for compliance.

P.K. Garg, presiding officer, G.S. Goyal and Shashi Saini, members did not agree with the PUDA plea that they had filed an appeal with the state commission against ex parte order which was still pending for hearing.

The forum in its orders observed that although an application had been filed by PUDA with the state commission for setting aside ex parte orders made earlier, no stay had been granted to the applicant. It further observed that by not implementing the orders, PUDA had rendered themselves liable under Section 27 of Consumer Protection Act and their action of non-implementation was a contemptuous one.

Warrants of arrest against the PUDA estate officer have been forwarded by the forum to the SSP for compliance.
