February 12: Rubina Sayed, sister of Abu Sayamma alias Javed Fawda who was killed in a police encounter in August, 1997, today told the encounters inquiry that her advocate, Majeed Memon, did not inform her that Samajwadi Party leaders had filed a petition challenging encounter deaths in the High Court.

Deposing before Principal Sessions Judge AS Aguiar, Rubina said while she was unaware that Abu Asim Azmi had approached the court on her behalf, she had discussed the case with the other petitioners, SP activists Shaila Mulay and Waqarunissa before she signed the affidavit. However, they also did not inform her that they had already moved court, she said.

Rubina said she had narrated the case to Memon and filed an affidavit dated November 18, 1997. While Memon was recording the affidavit, she did not tell him of her brother’s earlier arrest, as she herself was unaware about it until after his death, she added. She also said Memon knew that her brother was also known as Javed. j During cross-examination bySpecial Public Prosecutor of Mumbai Police Shrikant Bhat, Rubina denied that her brother was wanted by the Dharavi and Nagpada police stations and the crime branch. She also reiterated that when she visited the morgue to identify her brother’s body, the bodies were stacked one above the other, and her brother’s legs were fractured. There was a bullet injury on his private parts and right ear, she said.

Rubina also said she had told her advocate while preparing the affidavit that there were wheel marks on her brother’s body. She said she could not be sure whether her advocate had recorded this statement in the affidavit.
