NEW DELHI, Aug 25: The Delhi High Court will hear the Central Bureau of Investigation’s appeal against discharging of former Delhi Chief Minister and Bharatiya Janata Party leader Madan Lal Khurana and four Jains by the designated court in the multi-crore hawala case on Tuesday.

The case will be heard by Justice Jaspal Singh, before whom the matter has been listed.

The CBI had approached the High Court on August 13, seeking quashing of the discharging of Khurana, Surendra Jain, J K Jain, Balwant Rai Jain and J K Jain from charges of criminal conspiracies in hawala transactions on the grounds that it had evidence to prove their involvement in the scam, which rocked the country early last year.

The investigating agency had termed the order of special judge V B Gupta `erroneous’.

The CBI had charged Khurana with receiving Rs three lakh from the Jains as illegal gratification while holding public office in 1991. The former Delhi Chief Minister was a member of the Metropolitan Council of Delhi from February 1983 to December 1989.

The designated court had discharged Khurana after finding no grounds and evidence to prove offences under Section 120-B of the Indian Penal Code (IPC) (Criminal Conspiracy) and under Section Seven, 12 and 13 (2) read with 13 (1) (D) of the Prevention of Corruption Act, 1988.In its petition filed through counsel R S Jamuar, the CBI has cited 28 grounds, which it alleged, were not considered by the designated court while discharging Khurana.
