MUMBAI, MAY 5: The Bombay High Court on Wednesday stayed a government resolution proposing to prevent the D Y Patil Education Society’s medical college at Kolhapur, from using 400 beds at the Civil Hospital, Kolhapur for training purposes.

The bench of Justice A P Shah and Justice D Y Chandrachud, while staying the GR dated January 31, 2000 issued by the Public Health Department, also admitted the petition and posted it for final hearing.

D Y Patil Education Society which runs the D Y Patil Education Society’s Medical College had obtained permission from all authorities for the use of 400 beds at the Civil Hospital, Kolhapur for utilisation by the students for trainig purposes. The petitioner society was paying a license fee for the beds and by a letter of June 11, 1999, the deputy director of health services had extended the facility till November 2003.

However, they claimed that “without any reason whatsoever, the secretary, public health department issued a letter no DHB/2997/CR-136/A-3 dated January 31, 2000 stating that the execution of the letter was stopped till further orders.

In the court, senior advocate Ramrao Adhik argued that the present batch of 550 students in the college are undergoing compulsory internship in the area at the civil hospital. An arbitrary decision by the state government would jeopardise the lives, education and prospects of the students of the college, it was argued.

Claiming that the college was constructing its own hospital, which would be complete by 2003, the petitioners claimed that the State GR should be quashed and set aside.
