AUGUST 20: The Bombay High Court today rejected a petition praying for a CBI inquiry into the union leader Datta Samant's murder. The petition was filed by his brother Dada Samant, who said he doubted the seriousness of the present inquiry being conducted by Crime Investigation Department, Mumbai.Samant, represented by his advocate Niteen Pradhan, alleged that an industrialist was behind the murder and the police were deliberately shielding the culprit. Commissioner of Police Subhash Malhotra had denied the charge in an affidavit. The division bench of Justice V P Tipnis and A B Palkar heard both the sides.The judges ruled that as per the Criminal Procedure Code, investigation carried out by the police should not be disturbed. The CrPC states that courts should be slow while intervening in such matters. They can intervene and change the investigating agency only if there is some demonstrative evidence to prove bias.
