MUMBAI, August 25: The Bombay High Court has ordered the state government to inquire into the “temporary status” of daily wage workers of the Karad Municipal Council.

Two such workers, who have not been confirmed for the last ten years, moved the court in representative capacity on August 20. The next hearing will take place on September 4. The court has directed assistant government pleader Manohar Zambre to seek instructions from the authorities. Meanwhile, the division bench of justice Ashok Agarwal and S D Gundewar has suggested that the municipal council be directed not to fill the vacancies.

The petitioners, represented by advocate Deepa Chavan, stated that the Karad municipality had appointed them in 1983, after the state government did not sanction new posts to handle increased workload in departments like octroi, public works and house tax. The daily wage workers came in handy to fill up the vacancies without much financial burden. But even after these employees completed five to ten years in service, they were not confirmed.

The services of these `temporary’ workers were terminated in 1993. The workers then approached the Industrial Court of Kolhapur, which maintained that their complaints were partly correct.

Therefore, the municipal council filed four petitions in Bombay High Court, which still await a final order. No interim relief was granted. The petitioners state that a decade-long service deems them permanent, as per the Maharashtra Municipalities Act, 1965.
