A division bench of the Madras High Court today dismissed as ‘‘not pressed’’ a plea from the state government to stay the operation of an order of the Poonamallee special court for POTA cases granting conditional bail to MDMK leader Vaiko.
The bench comprising Justice V.S. Sirpurkar and Justice F.M. Ibrahim Kalifulla, however, admitted the main appeal from the state challenging the POTA court order and posted it for further hearing along with the application of Vaiko seeking modifications in the conditions laid down by the trial court while granting him bail. The main appeal prayed for cancellation of bail granted to Vaiko on February 3.
On Saturday, the state government had filed a petition challenging the grant of bail to Vaiko contending that the designated POTA court had failed to take note of the gravity and seriousness of the offence for which the leader was being tried while granting him bail.
