The Supreme Court on Monday, after being informed of the “procedural” difficulties faced by the Government in getting a copy of an Argentine court’s order rejecting the extradition plea of Ottavio Quattrocchi, agreed to grant it time till January 14.
Additional Solicitor General Gopal Subramaniam told a bench headed by Chief Justice K G Balakrishnan that more time was required to get a “true and correct translation” of the order from Spanish to English.
The SC on August 20 had directed the CBI to get the order of the Argentine court translated within three months.
On June 8, 2007, the El Dorado court in Argentina refused to grant a plea of the Government of India seeking extradition of Quattrocchi, prime accused in the Bofors kick-backs.
The Italian businessman, who was detained on February 6 on the basis of a Red Corner notice, was released on bail on February 23.
Gopal Subramaniam told the court on Monday that the Indian Embassy in Argentina was asked to approach the court there for a translation of the order. However, it was learnt that there was no translator in the court there, he said.
The ASG said there was no extradition treaty with Argentina, another obstacle in the case. The court posted the matter for January 14.
Petition seeks guidelines for appointment of CAG
NEW DELHI: A petition was filed in the Supreme Court on Monday seeking to lay down a proper procedure for the appointment of Comptroller and Auditor General of India.
According to an NGO, which filed the peititon, for want of any guidelines or procedure, the post of CAG had been given to bureaucrats on the verge of superannuation, who had no experience of accounts and audit. Kamini Jaiswal, counsel for the NGO, also argued that there were apparent chances of conflict of interests in cases, say, when a former secretary of a particular department or ministry takes the post as he or she will have to inquire into various deals taken place during their tenure.
So to avoid such circumstances, the counsel submitted, a procedure similar to those for the appointment of Chief Vigilance Commissioner or Chief Information Commissioner need to be laid down.
