Gorakhpur police defy HC order, do not file FIR against Yogi

Despite instructions by the Allahabad High Court, the Gorakhpur police failed to lodge an FIR against firebrand BJP parliamentarian Yogi Adityanath for his alleged involvement in spreading communal violence in nearly a dozen districts of eastern Uttar Pradesh in 2007.

Despite instructions by the Allahabad High Court, the Gorakhpur police failed to lodge an FIR against firebrand BJP parliamentarian Yogi Adityanath for his alleged involvement in spreading communal violence in nearly a dozen districts of eastern Uttar Pradesh in 2007.

During a hearing of a writ petition on September 26, the HC had directed the chief judicial magistrate of Gorakhpur to ensure that an FIR is lodged against the MP within 24 hours. After receiving the order’s copy on October 16, CJM Ajay Kumar Tripathi had directed the Cantt police to lodge the FIR within 24 hours and inform the court accordingly.

Parwez Parwaaz, a Gorakhpur-based journalist, had filed the writ in the Allahabad High Court against Adityanath for allegedly spreading communal violence, which claimed about half a dozen lives. “Even after HC instructions and orders from the chief judicial magistrate, the Gorakhpur police could not muster courage to lodge an FIR against Adityanath,” said Parwaaz.

On January 27, 2007, the MP had allegedly conspired communal violence, which began from the DAV college

Gorakhpur and lasted for nearly two weeks.

Parwaaz said he had submitted a video CD in the High Court. The CD showed that the MP had incited crowds in his public meetings at various places including the meeting

at the DAV college on January 27. “The High Court had instructed that besides the MP, FIR should also be lodged against MLC Y D Singh, legislator Radha Mohan Das Agrawal, Mayor Anju Chaowdhry and former minister Shiv Pratap Shukla,” said the journalist.

Radhey Ram, the Senior Sub-Inspector at the Cantt police station, said, “We have a copy of the court’s order, but I cannot comment on the issue because SHO Inspector Mangla Tiwari, who was handling the case, has been transferred.”

Gorakhpur Senior Superintendent of Police R K Shrivastava said,” It is a high profile case. We cannot file a FIR directly. We are examining the court’s order and it will take time.”
