Opposition Bharatiya Janata Party (BJP) today received a shot in the arm with the Supreme Court refusing to stay a Gujarat High Court order restraining the Centre from placing the Justice U.C. Banerjee Committee report on the Godhra train carnage in Parliament.

Justice Banerjee Committee had reportedly concluded that the Sabarmati Express coach carrying kar sevaks was burnt from inside triggering off a chain of communal riots in the entire state of Gujarat and leading to the massive victory of Narendra Modi-led BJP in the Assembly elections.

A Bench of Justices K.G. Balakrishnan and D.K. Jain, which declined to stay the high court order, however issued notices to Neelkanth Tulisdas Bhatia (petitioner before the high court), Commissioner Railway Safety, Union ministries of Home Affairs, Law and Justice, Railways and Justice Banerjee Committee, Justice Nanavati Commission and the state of Gujarat on the Centre’s petition seeking to quash the high court order.

India sought a direction to stay the operation of the March 20 order of the Gujarat High Court restraining the Centre from tabling the report in Parliament.
