Flood relief: Patna HC rejects Sadhu’s bail plea

In a major setback to RJD Lok Sabha member Anirudh Prasad alias Sadhu Yadav, the Patna High Court today rejected his anticipatory bail plea in the multi-crore rupees flood relief scam, while the Vigilance Bureau moved a special court seeking an order to attach his property after declaring him an absconder.

Justice Chandramauli Kumar Prasad turned down Yadav’s prayer for anticipatory bail after hearing defence counsel Ganesh Prasad Singh and Advocate General P K Shahi for the prosecution. Yadav, MP from Gopalganj and brother-in-law of RJD president and Railway Minister Lalu Prasad, has been on the run ever since the special Vigilance court here issued a non-bailable arrest warrant against him on April 10.

The Vigilance Bureau has also issued a nationwide alert for his arrest.

Within hours of the rejection of his bail plea, the Vigilance Bureau moved special Vigilance Judge R N Prasad praying for issue of a proclamation notice declaring him an absconder to enable it to attach his assets to compel the MP to surrender, Additional Director General (Vigilance) Neelmani said.

He said the bureau’s Deputy SP in charge of Vigilance police station, Patna, Manju Jha, requested the judge to hear its prayer as early as possible.

Earlier, before the HC dismissed Yadav’s prayer, his counsel apologised for his client failing to mention his pending bail application in the special Vigilance court here in his petition filed in the Delhi HC, which had on April 17 stayed the arrest till April 24.

The defence counsel said the error was due to a “communication gap”.

The advocate-General said Yadav had committed the same “mistake” while filing his anticipatory bail petition in the Patna HC. He had not mentioned about the fate of his bail prayer filed in the Delhi HC. Praying that the Bench should not entertain Yadav’s application, Shahi said that when the Delhi HC had rejected Yadav’s prayer for anticipatory bail on April 24, there was no point in hearing the petition here.
