Exclusion of creamy layer ‘unjustified’: JD(U)

Sharad Yadav criticised the SC verdict to exclude the creamy layer from OBC quota saying that its against the spirit of the constitution.

Terming the Supreme Court verdict excluding creamy layer from OBC quota as “unjustified and deplorable”, JD(U) demanded the setting up of a Joint Parliamentary Committee to review implementation of reservation for OBCs in the past 14 years.

The party also demanded a caste-based census for reviewing progress made by a particular community. Maintaining that the creamy layer provision was against the spirit of Constitution, JD(U) president Sharad Yadav said that it has denied backward classes adequate share in government jobs and services.

“There is no provision of creamy layer in Constitution and it is an invention of the Supreme Court. Constitution wants to ensure adequate reservation to all backward classes in government jobs while the creamy layer provision has denied it,” he said in New Delhi.

“The Joint Parliamentary Committee must review the implementation of OBC quota in the past 14 years,” he said. Noting that there was no data on castes as no caste-based census has been conducted since Independence, he said that there was a need for such a count in the wake of Supreme Court asking the government to periodically review the OBC list.

“How can you review the performance of a caste without any data? If the government wants to implement the apex court order of reviewing the OBC list, it has to periodically update the data,” he said.
