PATNA, Aug 12: Bihar Director General of Police (DGP), SK Saxena, today informed the designated CBI court that any precipitate action on the part of the authorities to execute the arrest warrant against former state Chief Minister Laloo Prasad Yadav would have led to violence.
“Any precipitate action would have led to police firing and killing of a large number of people,” the DGP told CBI judge, S K Lal, in his written reply to a court notice. The notice was issued following a CBI complaint that the DGP did not cooperate with the agency in executing the arrest warrant against Yadav in the fodder scam.
Though the state police extended all possible assistance to the agency, the ground situation on the night of July 29 and morning of July 30 prevented the arrest of Yadav, the report claimed.
Recounting the developments of July 29, the DGP’s report said the CBI directorate issued orders for Yadav’s arrest at 6.30 pm following rejection of his anticipatory bail by the Supreme Court. Subsequently, some state police officials had held talks with DIG (CBI), RN Kaul. The DGP said, at 10.30 pm the former chief minister declared through the media that he would surrender before the trial court the next morning.
At 11.45 pm Kaul phoned the DGP seeking adequate security for execution of the warrant, but intelligence reports emanating from the chief minister’s residence said a large number of media persons and ruling party supporters had gathered inside the premises.
“There was a feeling among RJD sympathisers that there was a move to humilitate Yadav by arresting him despite his announcement of surrender,” the report said.
The DGP went to the Chief Minister’s residence early on July 30. Senior officials, including Patna district magistrate, senior police superintendent and others present there were of the view that if the crowd was forcibly evicted, there was possibility of breach of peace.
