PATNA, NOV 12: A special court today rejected former Bihar chief minister Laloo Prasad Yadav’s prayer for regular bail in a fodder scam case saying, “Mr Yadav prime facie appears to be involved in the conspiracy of the scam”.Designated CBI judge S K Lal, in his order said “On perusal of documents and certain files, it appears that the accused (Yadav) is prime facie involved in the deep-rooted conspiracy of the multi-crore scam and thus, the petition is disallowed”.
The court had on Monday reserved its order on Laloo’s petition in the conspiracy case (RC 64 (A) 96) relating to fraudulent withdrawals of more than Rs 97 lakh from Deoghar treasury by the Animal Husbandry department.
The designated court has already referred Yadav’s earlier petition to the Patna HC for right of compulsory bail in this particular case. The judge referred the case to HC court under section 395 of CrPC.
Yadav in his petition has alleged that the CBI has filed the charge-sheet in the case without “obtaining sanction from the Governor”.
“Since the cognisance of the charge-sheet cannot be taken in the absence of the sanction, I should have the privilege of compulsory bail as the mandatory period of my remand in judicial custody has already expired,” Yadav argued. CBI filed the charge-sheet one day before expiry of the mandatory period of 90 days of judicial remand. The petition is likely to come up for hearing in the HC in a couple of days.
