The Srinagar city magistrate has summoned sitting National Conference (NC) MLA of Kupwara Mir Saif-u-ullah in a sexual assault case after the chairperson of a local NGO filed a complaint alleging he had attempted to rape her.

Mir and directed him to be present in court on December 22.

In her written complaint to the court, Waheeda Shah, Chairperson of NGO Habba Khatoon Foundation, had requested the Chief Judicial Magistrate (CJM) to take action against the MLA under Section RPC 506/509, 376/511 and 500. Shah had filed the complaint on December 1 before CJM Srinagar and the CJM had transferred the case to the City Magistrate.

Beig recorded her statement on December 2 and after hearing the arguments of her lawyer, he issued the summons. Waheeda had said that for the last one year, young girls had been complaining to her about behaviour of the MLA.

She alleged that he was luring girls on pretext of providing jobs.

After hearing these complaints, Waheeda stated, she fixed an appointment with him on November 19, at 3.30 pm at his Jawhar Nagar residence to ascertain facts.

Waheeda, along with a few girls went to his house and Mir asked Waheeda to go to the other room to discuss the issue.

‘‘I thought he will explain his position on these allegations,’’ the complaint read. ‘‘Mir locked the door and tried to rape me,’’ the complaint said.

‘‘I immediately raised an alarm and the other girls broke open the door and saved me,’’ she said. ‘‘Immediately we left his residence and reported the matter to the police. But they refused to lodge FIR as he is an MLA,’’ she said.

Mir said it was a false allegation. ‘‘I feel my political enemies are trying to defame me,’’ he told The Indian Express.
