The family of a 44-year-old NRI killed in a road accident has been awarded Rs 1.75 crore as compensation, including interest, by a Delhi court which has directed the owner of an uninsured tractor that led to the incident to pay the amount.
“It is clear that Rajesh Kheterpal (victim) had suffered fatal injuries…in the accident due to rash and negligent driving of the offending vehicle at the time of the accident,” Motor Accident Claim Tribunal (MACT) judge Swarana Kanta Sharma said.
She said the tractor owner Mohd Sahid and driver Mohd Hanif should pay the compensation of Rs 1.15 lakh along with an annual interest of 6 per cent from 2002, the year of filing the compensation application.
The liability to pay the amount was fixed on the tractor owner and the driver as the vehicle did not have a third party insurance.
Khetrapal, who was working as master in Wallem Ship Management Ltd, Hong Kong, had died after being hit by a tractor while driving a car, carrying his wife and two minor children, from Gurgaon to Delhi on November 19, 2000.
The NRI was going to his family house in New Rajinder Nagar from Sushant Lok Phase-II in Gurgaon where he had gone to see a flat. When his car reached a T-point near the Golf Club, the offending tractor, which was also travelling on the road, took a sharp turn and hit his car.
Deciding the petitions filed by Shelly Khetrapal, wife of the victim, their two children Siddhartha, 3, and Nupur, 8, and her parents-in-law Bimla and Ramesh, the court took into consideration the loss of dependency, love and affection and medical expenses due to the mishap while computing the compensation under the Motor Vehicles Act.
